1. Agreement to Terms

By accessing and using PlantLore, the plant identification and collection application (the "Application", "Service", "we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access or use the Application. For Apple users, this application is also licensed to you under the Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement (LAEULA), which you can review here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. For users who downloaded this application from the Google Play Store, your use of the Application is also governed by the Google Play Terms of Service and Google Play Developer Distribution Agreement, which can be reviewed here: https://play.google.com/about/play-terms/ and https://play.google/developer-distribution-agreement.html

2. Description of Service

The Application provides AI-powered plant identification services. We utilize third-party services including Google and Supabase.

Disclaimer: The Application is provided for reference and educational purposes only. Plant identifications should not be relied upon for official identification, especially for determining edibility, medicinal use, or safety. The plant identification technology is not 100% accurate, and users should always review results with caution. Users should always consult with qualified professionals or experts before making any decisions based on plant identifications provided by the Application.

3. Subscription and Pricing

3.1 Trial Period

• New subscribers to annual plans receive a complimentary 7-day trial period. New subscribers to weekly plans receive a complimentary 3-day trial period. Trial eligibility is contingent upon the user not having previously subscribed to any plan within the Application.
• During the trial period, users have full access to all premium features.
• A valid payment method is required for trial activation.
• For iOS users, subscriptions are processed and managed through the Apple App Store. For Android users, subscriptions are processed and managed through Google Play.

3.2 Free Users

• Free users can use the app with limited attempts. As of date of writing, this limit is 3 attempts upon installation.
• Free users have access to basic features with limitations
• Free users can upgrade to a subscription plan to increase usage limits

3.3 Subscription Plans

• After the trial period, users must subscribe to continue using premium features
• Weekly and yearly subscription options are available
• Pricing will be clearly displayed before purchase
• Subscriptions automatically renew unless cancelled before the renewal date

3.4 Payment Terms

• All payments are processed through secure third-party payment processors
• Prices are subject to change without notice
• No refunds for partial subscription periods
• Users can cancel at any time, with access continuing until the end of the billing period

4. Data Processing and Storage

4.1 Photo Processing

• Plant photos are processed using Google's AI services, subject to their Terms of Service (https://ai.google.dev/gemini-api/terms)
• Processing is subject to Google's terms of service and privacy policy
• The photos you upload are used solely for plant identification, they may be stored temporarily for processing and will be removed within 48 hours after processing is complete.

4.2 Data Storage

• User data and authentication are handled through Supabase, subject to their Terms of Service (https://supabase.com/terms)
• Storage and handling of data are subject to Supabase's terms of service
• We implement reasonable security measures to protect your data

5. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not attempt to circumvent any limitations or security measures
• Not use the Service to process or store illegal or harmful content

6. Intellectual Property

6.1 User Content

• You retain rights to your original photos
• You grant us a limited license to process and store your photos as needed to provide the Service
• You are responsible for ensuring you have the right to use any photos you upload to the Application.

6.2 Application Content

• The Application, including all software, design, and features, is our intellectual property
• You may not copy, modify, distribute, or reverse engineer the Application

7. Limitations of Liability

7.1 Service Availability

• The Service is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for any loss of data or service interruptions

7.2 Third-Party Services

• We are not liable for the performance or availability of third-party services
• Google and Supabase services are subject to their respective terms and conditions
• Users acknowledge the inherent risks in cloud-based services

8. Termination

We may terminate or suspend your access to the Service:

• For violations of these Terms
• For fraudulent or illegal activities
• At our sole discretion, with or without cause
• Without prior notice

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via:

• In-app notifications
• Email notifications
• Updates to the "Last Updated" date

Continued use of the Application after changes constitutes acceptance of the new Terms.

The Application is designed for personal, educational, and non-commercial use. We expect all users to use the Service responsibly and in accordance with the following fair use guidelines:

• Use the Application for legitimate plant identification purposes only
• Do not attempt to overload our systems with excessive requests or automated queries
• Respect the usage limits associated with your subscription plan or free account
• Do not share account credentials or attempt to circumvent usage limitations

13.2 Commercial Use

Commercial use of the Application requires prior written consent from us. Commercial use includes, but is not limited to:

• Using the Application to provide plant identification services to third parties for profit
• Integrating the Application's functionality into commercial products or services
• Bulk processing of plant images for commercial databases or research
• Reselling or redistributing identification results obtained through the Application

13.3 Automated or Systematic Use

The following activities are prohibited without express written permission:

• Using bots, scripts, or other automated tools to access the Application
• Systematic downloading, copying, or extraction of content or data
• Creating derivative databases from our identification results
• Reverse engineering our plant identification algorithms or methodologies

13.4 Enforcement and Consequences

We reserve the right to monitor usage patterns and take appropriate action when fair use policies are violated. Consequences may include:

• Warning notices and requests to modify usage behavior
• Temporary or permanent suspension of account access
• Rate limiting or throttling of service access
• Termination of subscription without refund
• Legal action to protect our intellectual property and systems
